When analyzing EB5 projects, there are many important factors to consider for green card issuance and capital repayment. While some points are more important than others, they should all be considered when making a final decision. One crucial factor is project financing. It’s critical that the EB5 project has all of the financing in place, meaning that the project has already shown how and where they will get the money from to complete construction. Recently, USCIS issued a Request for Evidence (“RFE”) on a project that was not able to show financing in place. Ensuring the project financing is complete will minimize risks of construction not being completed & job creation. If project construction is not completed due to financing, it could lead to jobs not being created and the EB5 investment not being repaid.
